Terms & Conditions

These Terms & Conditions (the “Terms”) are an agreement between you and MTN HLTH 1 LLC, doing business as “MTN HLTH” (“MTN HLTH,” “we,” “us,” or “our”), a medical clinic located at 186 N 100 E Suite A Room 6, Kaysville, Utah 84037.

They govern your use of this website, the MTN HLTH mobile application, and any MTN HLTH membership, visit, or service you purchase. By creating an account, booking a visit, purchasing a membership, or using the website or app, you agree to these Terms. If you do not agree, do not use our services.

Please read Section 4 (Membership Billing, Auto-Renewal & Cancellation) carefully. It describes recurring charges that continue automatically until you cancel.

1. Who We Are

“MTN HLTH” is the trade name of MTN HLTH 1 LLC. We operate a membership-based wellness and longevity medical clinic in Kaysville, Utah. Clinical services are provided by physicians, nurse practitioners, physician assistants, and other clinicians licensed to practice in the state where care is delivered.

Our contact details are at the end of these Terms and in the footer of every page of this site.

2. Our Services

MTN HLTH sells recurring clinic memberships and individual visits. Depending on the plan you choose, a membership may include some or all of the following:

  • Scheduled visits with your provider — in our Kaysville, Utah office, by video, or by phone, as clinically appropriate.
  • Direct messaging with your care team through the MTN HLTH app between visits.
  • Review and interpretation of your lab results.
  • A personalized wellness plan, maintained and updated by your provider.
  • Prescription management and refill handling where appropriate.

What is not included

Unless a plan says otherwise, the membership fee does not include the cost of laboratory testing, medications, supplements, imaging, or services performed by outside providers. Laboratory testing is available to members at our contracted laboratory rate and is billed separately. Medication pricing varies by prescription and is quoted to you before it is filled.

Membership is not insurance

An MTN HLTH membership is not health insurance, is not a health plan, is not a health-care sharing ministry, and is not a substitute for any of them. It does not pay for care you receive anywhere else, it does not cover hospitalization, emergency care, or specialist care, and it does not satisfy any legal requirement to carry health coverage. We do not bill insurance for our services. You are responsible for maintaining whatever health coverage you want or need.

3. Eligibility and Your Account

You must be at least 18 years old and legally able to enter a contract to create an account or purchase a membership. You agree to give us accurate, current, and complete information about yourself — including your medical history, medications, and allergies — and to keep it updated. Care decisions are made from what you tell us.

You are responsible for keeping your account credentials confidential and for everything that happens under your account. Tell us immediately if you believe your account has been used without your permission. Do not share your login with anyone; your account contains your protected health information.

4. Membership Billing, Auto-Renewal & Cancellation

This section describes a recurring, automatically renewing charge. Read it before you join.

4.1 Plans and prices

Current membership prices, in U.S. dollars, are:

  • Full Longevity Membership $195 per month billed monthly; $417 per quarter (equivalent to $139 per month); or $750 every six months (equivalent to $125 per month).
  • Couples Membership $387 per person per quarter (equivalent to $129 per person per month); or $696 per person every six months (equivalent to $116 per person per month). The Couples discount is not available on monthly billing.
  • TRT Only Membership $139 per month billed monthly; $297 per quarter (equivalent to $99 per month); or $534 every six months (equivalent to $89 per month).

The price you are shown at checkout is the price you pay. Prices are exclusive of any applicable taxes. We may change membership prices; a price change never applies to a period you have already paid for, and we will give you notice before a changed price is charged (see Section 13).

4.2 Automatic renewal

Your membership renews automatically at the end of every billing period and continues until you cancel. If you are on monthly billing you are charged every month, on quarterly billing every three months, and on six-month billing every six months — on or about the same calendar day each period, using the payment method you have on file.

Before you purchase, we disclose the plan, the amount, the billing frequency, the automatic-renewal term, and how to cancel, and you must affirmatively agree to them. You can see your plan, your renewal date, and your payment method at any time in the Billing area of the MTN HLTH app. After you purchase we send you a written acknowledgement containing the same information, including cancellation instructions.

4.3 Payment authorization

By purchasing a membership you authorize MTN HLTH and our payment processor to charge the payment method you place on file for the recurring membership fee, for each renewal period, and for any other amount you owe us under these Terms — including visit fees, late cancellation or missed visit fees, laboratory charges, medications, and products you order. This authorization continues until you cancel your membership and settle any balance owed.

Keep a valid payment method on file. If a charge is declined we may retry it, contact you, and pause non-urgent services until the balance is paid. You are responsible for amounts that remain unpaid.

4.4 How to cancel

You may cancel your membership at any time by giving us at least 30 days’ notice before your next billing date. Cancelling is meant to be at least as easy as joining. We accept cancellation through any of these channels — you do not have to use a particular one:

When you cancel, we schedule your membership to end and confirm the date with you. The cancellation is applied on or just before your next bill date, so no further charge is taken, and your membership stays active — with full access to visits, messaging, and your plan — until it takes effect. Because the notice period is 30 days, a cancellation given less than 30 days before a renewal date will normally take effect at the end of the following billing period, and that renewal will be charged. Fees already charged are not refunded mid-cycle (Section 4.5).

4.5 Refunds

Membership fees are not refunded mid-cycle. Once a billing period has been charged — monthly, quarterly, or six-month — that period is not refunded or pro-rated, in whole or in part, whether or not you use the services during it. Your membership instead remains active for the full period you paid for. This does not limit any right you have that cannot be waived under applicable law.

Duplicate and erroneous charges are always refunded. If we bill you twice for the same period, bill you after your cancellation was effective, or bill you the wrong amount, tell us and we will refund the incorrect amount to the original payment method. Refunds are typically issued within 5–10 business days of our confirming the error; the time it takes to appear on your statement is set by your bank or card issuer.

Our Refund & Cancellation Policy restates these rules in plain English. If the two ever disagree, this section controls.

5. Visit Fees, Late Cancellations, and Missed Visits

Some visits — including your initial visit — are paid for separately from your membership. The amount is shown to you before you confirm the booking, and your card is charged once the visit is confirmed. A card on file is required to hold a visit time.

Changing or cancelling a visit

Late changes, missed appointments, or cancellations within certain timeframes may be subject to fees, charged to the card on file. Any applicable fees are disclosed at the time of booking, or in the app before you confirm the change.

These fees exist because a reserved appointment slot cannot be given to another patient at short notice. We may waive a fee at our discretion — for example for an illness, an emergency, or a change we initiate. Whether a prepaid visit is refundable depends on when it is cancelled; the terms that apply are shown to you when you book and again when you cancel.

Other charges — laboratory testing, medications, supplements, and products — are quoted to you before you are charged for them.

6. Your Care

How care is delivered

Memberships include visits with your provider in our Kaysville, Utah office, by video, or by phone. Your provider decides which format is clinically appropriate for a given visit, and some services — physical examination, in-office testing, certain treatments — can only be delivered in person. Care delivered remotely is subject to the licensing laws of the state you are physically located in at the time of the visit; we may be unable to see you if you are outside a state where your provider is licensed.

No guarantee of outcomes

Medicine is not a product with a promised result. We do not guarantee any particular outcome, result, diagnosis, improvement, or benefit from any service, plan, or therapy. Individual results vary with your biology, your history, your adherence, and factors outside anyone’s control. Nothing on this website, in the app, or in any communication from us is a promise of a result.

Prescriptions

A prescription is issued only when a licensed clinician determines, after an appropriate evaluation, that it is medically indicated for you. Requesting a medication does not entitle you to receive it, and your provider may decline to prescribe, may stop a prescription, or may require testing or an in-person visit first.

Not for emergencies

MTN HLTH does not provide emergency medical services. If you are having a medical emergency, call 911 or go to your nearest emergency room immediately. Do not use app messaging, email, or a voicemail to report an emergency, a suspected heart attack or stroke, severe bleeding, trouble breathing, or thoughts of harming yourself or someone else. Messages are not monitored around the clock. If you are in crisis, you can also call or text 988 for the Suicide & Crisis Lifeline.

7. Privacy and Your Health Information

MTN HLTH is a health-care provider. Your health information is protected by the Health Insurance Portability and Accountability Act (HIPAA) and by our Notice of Privacy Practices, which describes how we may use and disclose it and what rights you have. Our Privacy Policy describes how the website and app handle information more generally, and our Cookie Policy describes our use of cookies. Where those documents and these Terms differ with respect to protected health information, the Notice of Privacy Practices controls.

Ordinary email and text messages are not secure. By giving us your email address and mobile number you agree that we may contact you at them about your care, your account, and your appointments, and you accept the risk that an unencrypted message could be seen by someone else. You can ask us to use a different method at any time.

8. Acceptable Use of the Website and App

You agree not to:

  • Use the website or app for any unlawful purpose, or in violation of these Terms.
  • Impersonate anyone, or create an account for someone else without their authorization.
  • Attempt to access another person’s account, records, or health information.
  • Probe, scan, or test the security of our systems; circumvent any authentication or rate limit; or introduce malware.
  • Scrape, harvest, copy, or republish our content, or use it to train a machine-learning model, without our written permission.
  • Interfere with the operation of the services or with anyone else’s use of them.
  • Post or transmit content that is unlawful, harassing, defamatory, or infringes someone else’s rights.

We may suspend or terminate your access, and may end your membership, if you violate these Terms, if you are abusive toward our staff, if you fail to pay, or if we determine we can no longer safely or appropriately provide you care. Where we end a membership for a reason other than your breach, we refund the unused portion of any period you have prepaid.

9. Intellectual Property

The MTN HLTH name, the MTN HLTH and ridgeline marks, the website, the app, and all text, graphics, photographs, video, layouts, software, and other content we provide are owned by MTN HLTH or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the website and app for your own health care. Anything not expressly granted is reserved.

Your own health records and the information you submit remain yours. You grant us permission to use that information as needed to provide your care, operate our practice, and comply with law, consistent with our Notice of Privacy Practices.

10. Disclaimer of Warranties

The website and app are provided “as is” and “as available.” To the fullest extent permitted by law, MTN HLTH disclaims all warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the services will be uninterrupted, timely, secure, or error-free, or that any content is accurate or complete.

Content on this website and in the app is educational. It is not medical advice and it does not create a provider-patient relationship — see our Medical Advice Disclaimer. This section does not limit or disclaim the professional duty of care your clinician owes you in the course of treating you, which no contract term can waive.

11. Limitation of Liability

To the fullest extent permitted by law, MTN HLTH and its owners, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of the website or app — whether the claim is based in contract, tort, warranty, or any other theory, and whether or not we were advised of the possibility.

To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the website, the app, or these Terms will not exceed the greater of the amounts you paid MTN HLTH in the twelve months before the event giving rise to the claim, or $100.

Nothing in this section limits liability for professional negligence, for personal injury or death caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law. Some jurisdictions do not allow some of these limitations, in which case they apply to you only to the extent permitted.

12. Indemnification

You agree to indemnify and hold harmless MTN HLTH and its owners, officers, employees, and contractors from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the website or app, your violation of any law or of anyone else’s rights, or information you gave us that was inaccurate or incomplete. This does not apply to any claim arising from our own negligence or misconduct.

13. Changes to These Terms

We may update these Terms. When we do, we change the effective date at the top of this page and post the updated version here. If a change materially affects your rights, your price, or your billing, we will notify you before it takes effect — by email, by app notification, or both — with enough notice for you to cancel before the change applies to a renewal. Continuing to use the services, or allowing your membership to renew, after a change takes effect means you accept the updated Terms.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or to our services will be brought exclusively in the state or federal courts sitting in Davis County, Utah, and you and MTN HLTH each consent to the personal jurisdiction of those courts.

15. General

Severability. If any provision of these Terms is held unenforceable, that provision is limited or removed to the minimum extent necessary and the rest of the Terms remain in full force.

No waiver. Our failure to enforce a provision is not a waiver of it.

Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.

Entire agreement. These Terms, together with our Refund & Cancellation Policy, Medical Advice Disclaimer, Privacy Policy, Cookie Policy, Notice of Privacy Practices, and any consent or membership agreement you sign, are the entire agreement between you and MTN HLTH on this subject. A signed clinical consent or financial agreement controls over these Terms to the extent it conflicts.
